Is Buying Marijuana Seeds Legal?

State laws matter:
- In adult-use legal states, residents can buy, produce, and sell seeds within state borders.
- In medical-only states, seeds can be purchased only with a valid medical card.
- Seeds cannot legally cross state lines.
International seed banks:
- Many operate in the Netherlands, Spain, and the UK.
- They often sell for “souvenir purposes,” but importing into the US is illegal—Customs will seize them if discovered.
DEA clarification (April 2022):
- Seeds with less than 0.3% THC are legally considered hemp.
- However, this is a regulatory determination, not federal law.
- Transport across state lines remains a legal gray area.

Overseas seed banks: large variety, but risk of confiscation.
US-based options:
- Some dispensaries in legal states sell seeds.
- Specialized seed companies within state lines.
Online:
- Research breeders’ reputations.
- Check grow journals for real-world results of specific strains.

Regular Seeds
- Mix of male and female plants.
- Require sexing to remove males (males create pollen, not buds).
- Often more genetically stable.
Feminized Seeds
- Guaranteed female, bud-producing plants.

Autoflower Seeds
- Transition to flowering automatically with age (not light cycle).
